QUESTION RE: 2K/2K3

I know in the topic for "Read this first, or you will probably be banned" (or however it's worded), it's mentioned that it is against the rules to ask for/link to warez, etc.
My question is, as 2k/2k3 was never legally released in America, aren't most people who are using it/talking about it/releasing games with it basically using pirated copies?
Correct me if I'm wrong, but it was released in Japan, and I'm sure there is an English patch out there, but as far as I'm aware, they were never released officially in English.
Thus my confusion as to why posting links to the pirated software is against the rules.
I don't care to use/pirate the software myself, and if I even cared to, a quick Google search would fulfill my needs, so there would be no point in posting here, asking how to get it.
Just wanna get a feel for the board and its policies. Basically, it seems like a "Don't ask, don't tell" scenario, but feel free to correct me if I'm wrong.
EDIT: Hehe...I guess I was right...

In addition we will continue our support of legally obtained versions of RMXP. We, however, will continue with our "amnesty" policy towards programs never released in english speaking countries, such as RM2K and RM2K3.
Yeah, we don't actually tell the users NO USE RM2k/3, but we have zero delusions about its legality. A download link is considered a link to warez as much as anything else, and will result in a verbal warning/ban if you repeatedly break the rules.
Outside of laziness and unwillingness to pay money for a consumer product; I don't get why people don't buy their copies of 2k3 in Japanese and patch them.
If it was easy to get a Japanese rm2k3 I would have already. And I would have actually made some games written in Japanese for fun and for practice in my minor field of study.
In a perfect world Google gets you everything.
In a perfect world.
(Although for some reason Enterbrain does still sell RM2K but not 2K3 anymore as I have demonstrated in the links in my thread asking for the Japanese purchases of these programs).
